Terms of Service

By accessing or using mysukari.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and mysukari.com ("My Sukari," "we," "us," or "our"), operated from Nairobi, Kenya. If you do not agree to these Terms, you must not use the Service.

Age Requirement: You must be at least thirteen (13) years of age to use the Service. If you are between 13 and 18 years of age, you may use the Service only with the consent of your parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

The Service is currently in beta and is provided on an early-access basis. Features, functionality, and availability may change or be removed without prior notice, and the Service may contain bugs or interruptions. By using the Service during this beta period, you acknowledge and accept these limitations. We will update these Terms when the Service exits beta.

My Sukari is a web-based glucose tracking application that provides tools for personal diabetes management, including:

• Manual and automated blood glucose logging, including data import and continuous glucose monitor integration
• Meal tracking with optional AI-assisted carbohydrate estimation from food photographs
• Medication and insulin dose tracking
• Data visualization, charts, statistics, and glucose pattern analysis
• Report generation and export
• Data sharing with designated caregivers or healthcare providers
• Health calculators

My Sukari is provided free of charge. All features essential for diabetes management are and will remain free. Should we introduce optional premium features in the future, we will notify you in advance, and any paid features will be clearly identified and separate from the core Service.

4.1 Account Creation

You may create an account using an email address and password, or by signing in through a third-party authentication provider (Google, GitHub, or Microsoft). You are responsible for providing accurate information and maintaining the confidentiality of your account credentials.

4.2 Health Data Consent

The Service collects and processes health data, which constitutes sensitive personal data under the Kenya Data Protection Act, 2019. Before you can use health-related features of the Service, you must provide explicit consent to the collection and processing of your health data. This consent is obtained through a dedicated consent mechanism during registration or at first sign-in. For full details, see our Privacy Policy.

4.3 Email Verification

Certain features of the Service, including the ability to log glucose readings, import data, track meals, and access integrations, require a verified email address. A verification email will be sent upon account creation. You must verify your email before accessing these features.

THE SERVICE IS A PERSONAL WELLNESS TOOL FOR GLUCOSE TRACKING AND IS NOT A MEDICAL DEVICE, DIAGNOSTIC TOOL, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

• Always seek the advice of your physician or qualified healthcare provider regarding any medical condition or treatment
• Never disregard professional medical advice or delay seeking it because of information provided by the Service
• If you experience a medical emergency, contact your local emergency services or healthcare provider immediately
• Data, statistics, charts, and analyses provided by the Service are for informational and personal tracking purposes only

The Service incorporates artificial intelligence for carbohydrate estimation from food photographs and descriptions. Regarding these AI features:

• AI-generated carbohydrate estimates are approximations only and may be inaccurate
• These results should not be used as the sole basis for dietary or medical decisions
• Food photographs submitted for analysis are processed by third-party AI providers and are not permanently stored by those providers after analysis
• You should always verify AI-generated estimates with your healthcare provider or a qualified nutritionist

By using the Service, you agree to:

• Provide accurate and truthful information in your account and health records
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• Use the Service in compliance with all applicable laws
• Not attempt to gain unauthorized access to the Service, other accounts, or our systems
• Not create multiple accounts or accounts on behalf of others without their consent
• Not use the Service to transmit harmful, unlawful, or objectionable content
• Not reverse-engineer, decompile, or attempt to extract the source code of the Service

The Service allows you to share your health data with designated individuals through secure share links. When using these features:

• You are solely responsible for determining who receives access to your health data
• You may revoke shared access at any time
• Share links may be configured with expiration dates and specific data permissions
• We are not responsible for how recipients use data you have chosen to share with them
• If you enable a public profile, your glucose statistics will be accessible to anyone with your username

All intellectual property rights in the Service, including but not limited to software, design, trademarks, and content created by us, are our exclusive property or the property of our licensors.

Your personal data and health records remain your property at all times. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and operating the Service. This license terminates upon deletion of your account.

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time, with or without notice
• Perform scheduled or emergency maintenance that may result in temporary unavailability
• Delete accounts that have been inactive for more than two (2) years, after providing reasonable notice
• Update or change features and functionality

We will make reasonable efforts to provide advance notice of significant changes that materially affect your use of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the fullest extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service
• Loss of data, profits, revenue, or other intangible losses
• Any actions, decisions, or health outcomes based on information provided by the Service, including AI-generated estimates
• Unauthorized access to or alteration of your data
• Interruption or cessation of the Service

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

By You: You may delete your account at any time through the Account Settings page. Account deletion permanently removes all your data and withdraws your health data consent. See our Privacy Policy for details.

By Us: We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in harmful or fraudulent activity, or if required to do so by law. We will make reasonable efforts to notify you before or promptly after such action, unless prohibited by law or where notification would compromise security.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Kenya. Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at info@mysukari.com.
